MINISTRY OF INDUSTRY AND TRADE ORGANIZES VIETNAM LOGISTICS FORUM 2022

Vietnam Logistics Forum is an annual event organized by the Ministry of Industry and Trade in collaboration with relevant agencies from 2013 to present. This is an important event of Vietnam's logistics industry with the goal of promoting the development of logistics services, creating a link between logistics and manufacturing and import-export industries, and also a place for dialogue and update information on important and urgent issues of logistics services in Vietnam and the world.

The annual forum has received the attention and appreciation of leaders of the Government, ministries, sectors, localities and businesses because of its practical significance in supporting businesses to connect and cooperate in business to attract investment to promote the development of the logistics service industry.

Vietnam Logistics Forum 2022 is the 10th forum held. The forum is held in the context of many new features. The implementation of free trade agreements such as CPTPP, EVFTA, RCEP requires businesses to make efforts to improve competitiveness. The Covid-19 epidemic has been controlled, but the post-pandemic socio-economic impacts along with the war in Ukraine are causing recession and inflation in many markets around the world, strongly affecting businesses industry in general and logistics service enterprises in particular. The Ministry of Industry and Trade is working with ministries, branches and localities to focus on removing difficulties, boosting production and export of goods, thereby effectively taking advantage of new FTAs, reducing damage caused by the epidemic and quickly restore growth momentum.

Logistics is a service industry that consumes energy and generates large emissions. Promoting the development of logistics services in parallel with energy saving, switching to environmentally friendly energy sources, using recyclable materials is a big task for the service industry logistics. At the COP-26 Climate Change Summit (November 2021), the Prime Minister pledged that Vietnam would reach net zero emissions by 2050. This is a very important goal, requires responsibility and strong participation of industries, including logistics.

To convey this message, orient and encourage logistics enterprises to comply with the requirements of energy saving, emission reduction, and clean energy use, the Vietnam Logistics Forum 2022 takes the theme of "Green Logistics". This is also the topic of the Vietnam Logistics Report 2022 published at the Forum.

DISPUTE OVER THE SHIPMENT OF ENZYMES IMPORTED FROM INDIA

The Insured’s Duty to Prevent and Mitigate Losses

Company T (Plaintiff – the Insured) entered into an insurance contract with Company B (Defendant – the Insurer). After the insured event occurred, the Insurer alleged that the Insured had violated its obligation to prevent and mitigate losses. The Arbitral Tribunal acknowledged that such an obligation exists but concluded that the Insured did not breach it.

Insurance Contracts Do Not Automatically Terminate Due to Late Premium Payment

Under the insurance contract, the premium was to be paid in three installments, and in all three, the insured party was late in payment. When a dispute arose, the insurer (Defendant) argued that the insurance contract had terminated before the insured event occurred due to the late premium payment and therefore refused to make an insurance payout. However, the Arbitral Tribunal held a contrary view.
